PURCHASE AGREEMENT
PUPPY/ADULT
TEANA SCOTT, dba PRANCING CHIHUAHUAS (hereinafter "Breeder") agrees to sell this puppy/adult to the purchaser (hereinafter "Owner") _________________________ entered into on this ____ day of (month)____________, 20__, for the agreed amount of: $_______ and Owner hereby agrees to pay said amount and to be bound by the terms and conditions of the agreement. As terms and conditions of this purchase, Breeder represents the following:
I. LIMITED WARRANTY
This Puppy/Adult is guaranteed against communicable diseases for 72 HOURS from the time the puppy leaves the Breeder's premises. This puppy is NOT guaranteed from fatal Head Trauma or bite, ears, molera, testicles, fertility, petalls, calcium drops or blood sugar drops, size color, cherry eye, hernias, but is against severe life-altering genetic defects. It the puppy dies before one year of age, the body must be autopsied. If cause of death was due to genetic birth defect I will replace the puppy with one of equality as soon as one becomes available. SOLD AS PET QUALITY, Breeder is not held responsible for injuries where the animal is very fragile and should be treated as a new born baby. All items covered under this guarantee are by replacement only. Breeder does not give cash refunds. Additionally, Breeder is not responsible for any medical expenses incurred, or any shipping costs.
Owner accepts and is aware that owning a puppy/dog includes regular veterinary care and thereby understands that he/she will be responsible for all related costs and payments; Breeder recommends Health Insurance for which information is thus included in a brochure with the kit sent home.
II. TERMS
1. PAYMENT – Owner agrees to remit payment by cash/money order, or PayPal; to be paid in full by the time the puppy is picked up or one week prior to shipping (if needed). Note: A 5% fee will be added for PayPal payments.
2. EXAMINATION – Owner agrees to have this puppy examined by a licensed veterinarian within 72 hours after the puppy leaves the Breeder’s premises. Should a problem be identified, the Breeder shall be informed immediately. If this Part of the contract is not carried out the guarantee on this pup shall be void and the pup will be considered “As Is.”
3. VACCINATIONS – Puppy is in good health and has had age appropriate vaccinations. The fact that this puppy/adult has been vaccinated does not guarantee immunity. It must receive a series of vaccinations that are given as recommended by your veterinarian. This puppy has received several doses of Wormer 2x dewormer for the treatment and prevention of Roundworms and Hookworms.
4. REGISTRATION – This puppy is sold as a companion animal, purebred and capable of AKC registration. Some puppies can be purchased with full or limited registration, this decision being made solely by the Breeder. Not all puppies are available for full registration. Please note that there is no guarantee of show or breeding quality set forth in this agreement.
[ ] FULL REGISTRATION: Is granted to responsible, established breeders. Puppies may not grow to be show or breeding quality. These dogs may require c-sections to give birth. You may have to hand-raise puppies by yourself which may require substantial time, work, and money toward properly raising a litter. Please be sure you are prepared for these situations before you decide to breed a litter.

[ ] LIMITED REGISTRATION: This puppy is not to be used for breeding. In the event Breeder is informed, learns or has reasonable evidence to believe that the puppy/dog has been breed, Owner will be subject to a fine of up to $5,000 and payment of related court and legal costs.
5. REFUND/REPLACEMENT – No monetary refunds will be given in any case or under any circumstances accept at the option of the Breeder. In the event of a fatal or severe life-altering genetic defect that is diagnosed by a licensed veterinarian before the puppy reaches one year of age, the puppy and its registration papers shall be returned to the Breeder.
The Breeder must be notified within two days of the veterinarian's findings. The Breeder will then make available to the Owner a replacement puppy of comparable value when one comes available, if you qualify for a replacement. If the puppy is a pre-purchase (i.e., if the puppy is born and you have picked it out but it’s too young to go to its new home) and the puppy for any reason isn’t thriving or dies while still with the Breeder, then the Breeder will notify Owner immediately and will make available to you the Owner a replacement of equal value when one becomes available. It is understood that the replacement puppy may not come from the same litter or from the same parents as the original puppy. Any physical problem that is or could be the result of injury is not covered by this guarantee.
Under the terms of this purchase agreement, the Owner must complete the following before any replacement decision will be made:
a) Return the puppy and its registration papers signed over to the Breeder;
b) Provide legible copies of the puppy’s medical records showing regular veterinary check-ups, current vaccinations, deworming, heartworm prevention, and good nutrition;
c) Provide a written statement signed by the veterinarian on his office stationary stating the health problem, supporting symptoms, and any tests done validating this diagnosis;
d) If the puppy is deceased or euthanized for any reason the Owner agrees at their expense to have a necropsy performed on the body and then supply the Breeder with a legible copy of such report; and
e) As Owner, accept responsibility for all shipping costs to and from the seller on a replacement puppy.
If for any reason, under any circumstance, a replacement puppy is offered and you decline it, this contract shall be considered completed and fulfilled. There will not be another puppy offered to you and you understand and agree that any money already paid to the Breeder will be forfeited, as there are no refunds.
5. TRANSFER/ASSIGN – This contract and all guarantees apply to the original puppy and Owner and is nontransferable/assignable to a third party without the Breeder's written consent.
7. RIGHT/OPTION – If at any point you cannot care for or keep your puppy for any reason, the animal must be returned to the Breeder at once. Breeders retain first option and/or right of refusal on all animals. If this puppy/dog is sold/given to a third party without the Breeder’s written consent the Owner shall be in breach of contract and shall be subject to damages.
8. SEVERABILITY – In the event that any portion of this agreement is deemed unenforceable, all other provisions of this agreement shall remain in full force and effect.
9. JURISDICTION – This contract shall be deemed a legal and binding contract and is under the jurisdiction of the State of Washington, in the County of Clark . It is further agreed that the place of venue shall be Clark County, Washington.
10. MISCELLANEOUS – This contract is null and void if the terms and conditions are not fulfilled. By signing this contract both parties agree to be bound by all terms set forth and that the buyer will take proper care of their new puppy. Owner fully agrees that if it is found that puppy/adult has been mistreated, neglected, or abused and such acts have endangered the health or mental state of this animal, the animal will be returned at once free of charge and without replacement to the Breeder.
